3.2 million pensioners to get automatic tax refunds after HMRC error

A significant number of senior citizens are due to receive tax repayments following an administrative mistake by HM Revenue and Customs in its state pension assessments.

Approximately 3.2 million individuals in receipt of the state pension have been impacted, with aggregate repayments anticipated to reach roughly £19.3 million.

On average, this translates to about £6 per affected person, though individual payment amounts will differ.

The discrepancy stemmed from the methodology employed by HMRC when determining annual state pension income for taxation purposes.

Normally, when the state pension increases during a tax year, the annual calculation should incorporate one week at the previous rate and 51 weeks at the new rate.

However, certain assessments instead applied the higher rate across the full 52 weeks.

This resulted in the annual pension income figure being overstated, potentially leading to excessive tax collection.

Tax specialist Andy Wood from Tax Barrister UK highlighted that such discrepancies could easily escape notice, as the pension figure appearing in tax calculations may seem entirely reasonable at first glance.

Wood emphasised that individuals impacted require comprehensive information regarding precisely which tax years have undergone review.

The HMRC correction programme encompasses affected assessments dating from the 2020/21 tax year onwards.

Those entitled to repayments do not typically need to submit applications, as corrections will be processed automatically via PAYE adjustments, Self Assessment credits, or alternative payment channels as appropriate.

Wood noted that automated corrections benefit those who had no reason to suspect any irregularities.

However, the accompanying explanation proves equally vital.

Recipients need to understand which tax years were examined, how their repayment amount was derived, and whether any outstanding issues remain unresolved.

One significant limitation exists: the automatic correction programme does not extend to tax years prior to 2020/21.

HMRC lacks sufficient data to address those cases automatically.

Nevertheless, individuals who believe they may have been affected in earlier periods can petition for a personal review and supply supporting documentation.

This means that those receiving automatic repayments should not automatically assume that every possible overpayment has been identified and addressed.

Wood stressed that HMRC should provide unambiguous clarification regarding the scope of this exercise, including what evidence would be considered for earlier periods.

Such transparency would assist pensioners in comprehending precisely what has been resolved and where additional questions might persist.
