Trading Standards clarifies Bradford shop’s snus name after complaints

Concerns have been voiced regarding how a newly opened business in Bradford can promote tobacco-free alternatives while referencing a product that has been prohibited in this country for more than thirty years.

Signage was spotted outside NIC Central Premium Snus & Vapes, situated at 151 New Line in Greengates, prompting objections from elected members of the local authority and unease among certain local residents.

However, the regulatory body responsible for consumer protection in West Yorkshire has clarified that the explanation may relate to evolving language among consumers, with the term traditionally associated with a banned tobacco product now frequently used to describe items that can legitimately be sold.

The enforcement agency disclosed that two separate complaints or enquiries have been logged in connection with the establishment.

These concerns have been noted for monitoring purposes, though officials refrained from indicating any breach of current legislation.

The situation arose after local politicians challenged whether the business branding was promoting an item that cannot legally be sold within the United Kingdom.

The fundamental legal distinction lies in the difference between conventional tobacco snus and modern nicotine pouches.

While the tobacco-containing version remains against the law, officials explained that the descriptive terminology has become increasingly applied to tobacco-free alternatives that fall within current regulations.

The enforcement agency referenced photographic evidence published by this publication showing branding for SnĂĽ, a manufacturer recognised for producing tobacco-free nicotine products.

Based on this evidence, officials determined that the presence of such terminology on the commercial premises does not automatically signify that prohibited items are being marketed or sold.

Significantly, the authority emphasised that existing legislation contains no provisions regulating such naming conventions in this particular context.

The dispute emerged after elected representatives objected to the arrival of the venture in recently renovated premises that previously housed a financial institution.

Community members had expressed hope that the vacant space would be transformed into a facility serving the neighbourhood rather than another establishment selling vaping merchandise.

The terminology used in the branding drew particular scrutiny due to its association with an outlawed oral tobacco preparation.

Government ministers have maintained their position that tobacco snus continues to be prohibited from commercial sale, with no indication of any policy reversal in this area.

Although the enforcement body identified no present irregularity with the commercial designation, officials drew attention to legislative reforms forthcoming under the Tobacco and Vapes Act 2026.

The new framework encompasses restrictions on promotional activity for tobacco goods, vaping merchandise and nicotine items, with implementation anticipated from the first day of June 2027.

These provisions may substantially reshape future marketing approaches within this commercial sector.

The enforcement authority reported that no official inspections of the premises have taken place.

Officials declined to elaborate on any prospective enforcement measures or internal operational considerations.

Nevertheless, the agency stated that statutory powers remain available should investigators establish that retailers are handling prohibited merchandise, encompassing examination procedures, confiscation of goods, court proceedings and criminal prosecutions.

For the time being, the regulatory position remains straightforward: despite the continued prohibition of tobacco-containing snus, the presence of such terminology in business identification does not necessarily indicate that unlawful products are being sold, particularly where the reference may pertain to legitimate tobacco-free alternatives.
